Bylaws for Mohawk 4 Wheel Drive Club                                                                                                                                                                                         

Article 1 NAME

The name of this non-profit organization shall be The Mohawk 4 Wheel Drive Club. The identifying decal for this organization shall have the organization’s name and a logo emblazoned upon it and other details as seen fit.

Article 2 PURPOSE

The purpose of this organization is to promote the use of 4 wheel drive vehicles for off highway driving, 4 wheel drive ownership, and camaraderie by it’s members, driving duly registered and insured 4WD vehicles capable of handling rough terrain.

Article 3 MEMBERSHIP

Membership in this organization shall be open to 4 wheel drive owners and their families, subject to approval of the club members upon receipt of appropriate recognition. A member shall receive upon initial membership a Membership Packet. All members and their families are entitled to attend all regularly scheduled events.

Article 4 VEHICLES

4WD vehicles only! Tow hooks in front are mandatory and some type of tow hook or receiver hitch, clevis, or other secure means of towing from the rear is required. A hitch ball is NOT acceptable for safe pulling of another vehicle. All non-steel top vehicles must have a roll bar. All vehicles must have seat belts for ALL occupants.

Article 5 MANDATORY EQUIPMENT

All vehicles must have a first aid kit, fire extinguisher, and TOW STRAP. A CB radio is optional. An FRS Radio is recommended.

Article 6 CLUB EVENTS

A club event is a regularly scheduled event for its club members, their families and passengers. Guest vehicles are welcome, and the responsibility of the inviting member. All drivers are responsible for keeping the vehicle behind them in sight.

Article 7 CONDUCT

All members of the club are expected to drive their 4 wheel drive vehicles in a safe and courteous manner, respect the rights of property owners and not willfully destroy, remove or damage in any way, the property of another club member or property owner, as per Tread Lightly.

Article 8 REMOVAL of a MEMBER

All members of the Mohawk 4 Wheel Drive Club are expected to conduct themselves in an appropriate manner. Should it be necessary to remove a member from the club for inappropriate behavior, a vote of not less than 2/3 (two-thirds) of the club will be required and the offending member shall be informed in writing within seven days stating the reasons for his/ her removal. A member has the right to appeal this decision with in 30 days in writing to the club president. The president will set up a hearing for the member to hear his/her case. The President’s decision will be final.

Article 9 DUES

The annual dues for an existing member must be renewed by January 31 of the current year. The current rate will be posted on The Mohawk 4 Wheel Drive Club  member/renewal application form, Club Web site, and the Newsletter. New Members joining after June 30 will only pay 50% of the annual dues.

Article 10 CLUB OFFICERS

The club officers include the President, Vice-President, Secretary, and Treasurer / Membership Chair.

 

Article 11 OFFICER ELECTIONS

Nominees for club office shall be members in good standing. Officers shall be elected every year. Elections are to be held at the annual March Dinner Meeting with the results posted in the minutes of that meeting. A special election may be held at any time to replace any officer.

Article 12 VOTING

All members in good standing, except the President, are entitled to vote and are encouraged to do so. One vote per club member and their family. There are no non-member votes. In the event of a tie, The President will cast the deciding vote, unless it is for his or her own election to office.

Article 13 MEETINGS and ORDER OF BUSINESS

The meetings of the club shall be held on the second Weekend of each odd numbered month. Each meeting shall start with a roll call. Should the roll call reveal less than 20% of the club members, the meeting shall be null and void and no official business may be conducted. Reading of the minutes of the last meeting of the club shall commence after roll call. Reports from officers, old business and new business shall be conducted in this order. Adjournments follow.

Article 14 AUTHORITY

All proceedings shall be governed by these bylaws, standard operating procedures put into effect by majority vote of the Mohawk 4 Wheel Drive Club.

Article 15 AMENDMENTS

Motions to change these articles may be made by any member in good standing at any scheduled meeting and must be seconded. All members shall be advised by Newsletter of the proposed changes and these motions will be voted on at the next regular scheduled meeting and approved by majority vote of all members present.  

Article 16 DISSOLUTION

Upon resolution to dissolve the Mohawk 4 Wheel Drive Club the assets of the club shall be distributed in accordance with State of New York laws governing such actions.
